NOTARY PUBLIC

Notaries Public perform essential functions in our society. They are expected to comply with the highest standards of behaviour as set out in the Notaries and Commissioners Act and the Notaries Public Regulation.


Notaries public in Alberta can administer oaths and take and receive affidavits, affirmations and declarations; attest oaths, affidavits or declarations; certify and attest true copies of original documents, and witness or certify and attest the execution of documents.


The Criminal Code places a high degree of responsibility on persons who administer oaths, affirmations and declarations. Section 138 of the Criminal Code provides that anyone who signs an affidavit or statutory declaration representing that it was sworn or declared before them when it was not is guilty of an offence and is liable to imprisonment for two years.


Before notarizing any document, a Notary Public must carefully review it to ensure it is not legally ineffective or irregular. Notarizing these documents could lead a person to believe that they have legal force when they do not.


If you need to notarize a document, we can certainly help you. Please bring in the following to get documents notarized:

  • one piece of government-issued photo ID; and
  • a second piece of ID that is either a credit card or health care card


All people who are signing the document must come to the appointment. We cannot notarize a document without being present when the document is signed. Bring in the document to be notarized. Bring in any paperwork that relates to the notarized document(s). Please do not sign the document to be notarized before your appointment. We will need to copy the original document for original true copies. Please bring in the original with you.


Examples of documents that need notarizing are:

  • passport applications;
  • lost, damaged or stolen passport applications;
  • affidavits;
  • statutory declarations;
  • child travel letters; and
  • immigration-related applications.


Some documents require more than notarization, which often delays dealing with the documentation. The most common areas that people book a notary instead of another service include Certificates of Independent Legal Advice, Personal Guarantees, Separation Agreements, out of province transfer of property documents and Cohabitation or Prenuptial Agreements. While these services do cost more than a notary, it is because there is a lot more work and liability involved.
